Michael Elliott, whose last known address is unknown and cannot with the exercise of reasonable diligence be ascertained, and upon whom service of summons cannot be had in the State of Ohio, will take notice that on the April 15, 2010, Plaintiff, filed a Complaint against him and others in the Common Pleas Court of Summit County, Ohio, being Case No. 2010 CV 51, representing that she is the duly appointed and qualified Fiduciary of the estate of Leonard F. Elliott, Deceased, brings this action with the consent of, and at the request of, all the persons entitled to share in the estate of said decedent upon distribution, as will appear by their consents and request filed herewith, and/or endorsed hereon; said decedent died seized in fee simple of the following described real estate proposed to be sold, situated in the City of Akron, County of Summit, State of Ohio, and described as follows: PARCEL NO. 1: One-half interest of land situated in the City of Akron, County of Summit and State of Ohio: And known as: Being Lot Number One Hundred Forty-nine (149) in the North Hill Allotment recorded in Plat Book 18, Page 16, said premises being forty (40) feet front on the East side of Marview Avenue, be the same more or less, but subject to all legal highways. PPN: 02-1428-01-007.000 67-26716 PARCEL NO. 2: One-half interest of land situated in the City of Akron, County of Summit and State of Ohio: And known as: Being Lot Number One Hundred Forty-eight (148) in the North Hill Allotment as recorded in Plat Book 18, Page 16, Summit County Record of Plats. PPN: 02-1428-01-006.000 67-26798 Commonly known as 465 & 467 Marview Avenue, Akron, OH 44310 that said real estate was included in the inventory of said decedent's estate and appraised at $83,000.00, which is its value as near as can be ascertained. Plaintiff further represents that the defendant, Michael Elliott is the person entitled to share in the estate of said decedent upon distribution; that the defendants Holly Sims and John Donofrio, are all the mortgagees and other lienholders whose claims affect said real estate or a part thereof, and all other persons having adverse interests in said real estate. The Plaintiff therefore prays that the rights, interests and liens of the said defendant(s) may be fully determined, adjusted and protected and that plaintiff may be authorized and ordered to sell real estate according to the statutes in such case made and provided, and for all other proper orders and relief in the premises, and to employ and pay a real state broker if needed in the sale of the real estate herein described.
