By virtue of an Order of Sale No. CV2016 02 0746 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

Known as being all of Lot No. 28 in the Ferdinand Schmacher's Allotment as recorded in Plat Book 5, Page 12, Summit County Records of Plats, further bounded and described as follows:

Beginning at the Northeast corner of Lot No. 28 (witness a 3/4" open top pipe found this survey 0.02 feet North and 0.04 feet East of point described) and in the West line of East Avenue, 60 feet wide:

Course 1: Thence South 00 deg. 04 min. 27 sec. West along the East line of Lot No. 28 and the West line of East Avenue, a distance of 65.99 feet to a #5 rebar and I.D. cap #6541 set flush this survey at the Southeast corner of Lot No. 28;

Course 2: Thence North 89 deg. 50 min. 16 sec. West along the South line of Lot No. 28, a distance of 130.76 feet to a point (witness a #5 rebar and I.D. cap #6541 set South 89 deg. 50 min. 16 sec. East, a distance of 1.50 feet from corner described) and the Southwest corner of Lot No. 28;

Course 3: Thence North 00 deg. 04 min. 31 sec. East along the West line of Lot No. 28, a distance of 65.99 feet to a #5 rebar and I.D. cap #6541 set flush this survey at the Northwest corner of Lot No. 28;

Course 4: Thence South 89 deg. 50 min. 16 sec. East along the North line of Lot No. 28, a distance of 130.75 feet to the place of beginning and containing 8,629 S. F. or 0.1981 acres of land, but subject to all legal rights and easements of record, be the same more or less, but subject to all legal highways, as surveyed in November 2004 by John W. Patrick, Jr., Professional Land Surveyor #6541.

Property appraised at: Fifty-seven Thousand Dollars ($57,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 9th day of November, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
