By virtue of an Order of Sale No. CV2018 07 3045 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 4TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio:

And known as being the East 51.53 feet of the West one-half of Lot No. 13 in the Falls Acres Allotment as recorded in Plat Book 37, Page 48, Summit County Records, and more fully described as follows:

Beginning at an iron pin monument set in the intersection of the North line of Magnolia Avenue (formerly Reed Avenue) with the West line of the said Falls Acres Allotment; thence Easterly along the North line of said Magnolia Avenue along an arc having a radius of 59.06 feet, a chord of 47.65 feet and a chord bearing of North 78 deg. 54' 45" East, a distance of 49.05 feet to a point; thence continuing along the North line of said Magnolia Avenue North 55 deg. 07' 10" East, a distance of 316.34 feet to an iron pin and the true place of beginning of the land herein to be conveyed; thence North 34 deg. 52' 50" West, a distance of 145.00 feet to an iron pin; thence South 55 deg. 07' 10" West, a distance of 51.53 feet to an iron pin; thence South 34 deg. 52' 50" East, a distance of 145.00 feet to an iron pin set in the North line of said Magnolia Avenue; thence North 55 deg. 07' 10" East along the North line of said Magnolia Avenue, a distance of 51.53 feet to an iron pin and the true place of beginning and contains .17 acres, be the same more or less, but subject to all legal highways.

Property located at: 839 Magnolia Avenue, Cuyahoga Falls, OH 44221.

Property appraised at: Ninety Thousand Dollars ($90,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 18th day of January, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
