By virtue of an Order of Sale No. CV2018 08 3558 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 4TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Springfield, County of Summit and State of Ohio:

And known as being a part of Lot E, Tract 3, further bounded and described as follows:

Beginning at a point in the East line of said lot and tract and in the centerline of the East Akron-Massillon Road, which point is South 0 deg. 32' 30" West, a distance of 1075.80 feet from the centerline of the Krumroy-Myersville Road, said point being the Northeast corner of a 13.83 acre parcel of land conveyed to M. and I. Warner by deed recorded in Vol. 640, Page 470, Summit County Records; thence South 0 deg. 32' 30" West, along the East line of said lot and tract and the center line of the said East Akron-Massillon Road, a distance of 69 feet to a point; thence North 88 deg. 02' 15" West, parallel to the North line of said 13.83 acre parcel of land, a distance of 632.53 feet to an iron pipe in the West line of said 13.83 acre parcel of land (an iron pipe is set on this line 30 feet from the centerline of said East Akron-Massillon Road); thence North 0 deg. 49' 0" East, along the West line of said 13.83 acre parcel of land, a distance of 69 feet to an iron pipe at the Northwest corner of said 13.83 acre parcel of land; thence South 88 deg. 02' 15" East, along the North line of said 13.83 acre parcel of land, a distance of 632.28 feet to the place of beginning (an iron pipe is set on this line 30 feet from the centerline of said East Akron-Massillon Road) and contains one acre of lands as surveyed by W. S. Mathews in April, 1944, be the same more or less, but subject to all legal highways.

Beginning at a point on the East line of said lot and tract and the centerline of the East Akron-Massillon Road at a point which is South 0 deg. 32' 30" West, and 1148.8 feet distant from the centerline of the Krumroy-Myersville Road as measured along the centerline of the East Akron-Massillon Road; thence North 88 deg. 02' 15" West, a distance of 305 feet to an iron stake and the true place of beginning; thence South 0 deg. 32' 30" West, a distance of 69 feet to an iron stake; thence North 88 deg. 02' 15" West, a distance of 327.78 feet to an iron stake; thence North 0 deg. 45' East, a distance of 69 feet to an iron stake; thence South 88 deg. 02' 15" East, a distance of 327.53 feet to an iron stake and the true place of beginning and containing within said boundaries an area of 0.519 of an acre, be the same more or less, but subject to all legal highways.

Property appraised at: One Hundred Eight Thousand Dollars ($108,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 18th day of January, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
