By virtue of an Order of Sale No. CV2019 01 0305 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 18TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Stow, County of Summit and State of Ohio:

And known as being Tract #5, Progress Park Estates, an unrecorded subdivision of part of Lot #58 in said township bounded and described as follows:

Beginning at an iron pin set in the North line of said Township Lot #58, a distance of 1251.10 feet East of its intersection with the center line of the Kent-Darrowville Road; thence East along said North lot line 293 feet to an iron pin; thence South 743 feet to an iron pin set in the center line of an undedicated road 50 feet wide; thence West along said center line 293 feet to an iron pin; thence North 745 feet to the place of beginning and containing 5 acres of land reserving therefrom a strip of land 25 feet wide along the entire South side thereof for road purposes. Subject to restrictions, conditions and limitations of record. Excepting therefrom the following described parcels.

And known as being Tract 5, Progress Park Estates an unrecorded subdivision of part of Lot 58 in said township and more fully bounded and described as follows:

Beginning at an iron pin set in the North line of said Township Lot 58, a distance of 1251.10 feet East of its intersection with the center line of the Kent-Darrowville Road; thence South a distance of 568.00' to a point and the true place of beginning of the parcel herein described; thence continuing South, a distance of 150.00' to a point of the North line of Progress Park Drive as recorded in Plat Book 76, Pages 23-25 of the Summit County Records of Plats; thence East along the North line of said Progress Park Drive, a distance of 97.66' to a point; thence North, a distance of 150.00' to a point; thence West a distance of 97.66' to the true place of beginning of the parcel herein described and containing 0.3363 acres of land, more or less, but subject to all legal highways, easements, and restrictions of record, as surveyed by John J. Knecht, Registered Surveyor No. 4548 in November 1992.

And known as being Tract 5, Progress Park Estates, an unrecorded subdivision of part of Lot 58 in said township and more fully bounded and described as follows:

Beginning at an iron pin set in the North line of said Township Lot 58, a distance of 1251.10 feet East of its intersection with the center line of the Kent-Darrowville Road; thence South a distance of 568.00' to a point; thence East a distance of 97.66' to the true place of beginning of the parcel herein described; thence South a distance of 150.00' to a point of the North line of Progress Park Drive as recorded in Plat Book 76, Pages 23-25 of the Summit County Records of Plats; thence East along the North line of said Progress Park Drive, a distance of 97.67' to a point; thence North a distance of 150.00' to a point; thence West a distance of 97.67' to the true place of beginning of the parcel herein described and containing 0.3363 acres of land more or less, but subject to all legal highways, easements and restrictions of record as surveyed by John J. Knecht, Registered Surveyor No. 4548 in November 1992. Be the same more or less, but subject to all legal highways.

Property located at: 2615 Progress Park Drive, Stow, OH 44224.

Property appraised at: Three Hundred Thousand Dollars ($300,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 1st day of November, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
