By virtue of an Order of Sale No. CV2019 03 1184 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 1ST DAY

OF NOVEMBER, A.D., 2019

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Block A of the Brittain Heights Subdivision as recorded in Plat Book 27, Pages 18-21 inclusive of Summit County Records and described as follows:

Beginning at a point at the Northwest corner of said Block A and the Southerly line of Adelaide Boulevard; thence Easterly along the Southerly line of Adelaide Boulevard and the arc of a circle whose radius is 805 feet with a central angle of 3 degrees 50' 50" and whose chord bears North 82 degrees 45' East, 54.80 feet a distance of 55 feet to a point; thence South 9 degrees 13' East, 110 feet to a point on a circle; thence Westerly on the arc of said circle whose radius of 915 feet with a central angle of 3 degrees 54' 50" and whose chord bears South 82 degrees 45' West, 61.52 feet, a distance of 62.05 feet to a point in the Westerly line of said Block A; thence North 5 degrees 18' West along the Westerly line of said Block A, 110 feet to the place of beginning and containing 0.148 acres of land, be the same more or less, but subject to all legal highways.

Property appraised at: Fifty-one Thousand Dollars ($51,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 15th day of November, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
