By virtue of an Order of Sale No. CV2019 05 1973 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 24TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

PARCEL 1:

Situated in the City of New Franklin, County of Summit and State of Ohio:

Known as being Lot No. 34 in the Kungle Allotment, as recorded in Plat Book 50, Pages 40, 41 and 42, Summit County Records of Plats, be the same more or less, but subject to all legal highways.

PARCEL 2:

Situated in the City of New Franklin, County of Summit and State of Ohio:

And known as being part of Lot 71 in the Kungle Allotment, as recorded in Plat Book 50, Pages 40-42, Summit County Records and being more completely described as follows:

Commencing at a 3/4 inch open top pipe marking the Northwest corner of Lot 70 in said allotment; thence N. 02 deg. 06' 26" W., along the Westerly line of Lot 71, a distance of 199.53 feet to the place of beginning for the parcel herein described.

1. Thence continuing along said line N. 02 deg. 06' 26" W., a distance of 309.90 feet to the North line of said allotment, passing over monuments at 99.88 feet a 3/4 inch closed top pipe, 155.64 feet a #5 rebar 5916, 277.50 feet a #5 rebar 5916.

2. Thence S. 68 deg. 48' 47" E., along said North allotment line a distance of 163.72 feet to a lead center monument (top rusted off).

3. Thence continuing along said allotment line N. 85 deg. 03' 10" E., a distance of 82.43 feet to the West right of way of Cleveland Massillon Road, as shown on said record plat and a #5 rebar 5916.

4. Thence along said right of way on a curve (radius 11389.16 feet, delta 01 deg. 18' 06", chord 258.77 feet chord bearing S. 02 deg. 55' 44" E.) an arc distance of 258.77 feet to a #5 bear 5916.

5. Thence N. 89 deg. 48' 21" W., a distance of 236.61 feet to the place of beginning. The above described parcel contains 1.4642 acres as surveyed in June 2016 by Lawrence L. Butterworth, Reg. Sur. 5916. North is assumed, set the monument West right of way of Cleveland Massillon Road to N. 00 deg. 04' 00" W. per record plat.

Property appraised at: Two Hundred Twenty-two Thousand Dollars ($222,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 7th day of February, 2020. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
