By virtue of an Order of Sale No. CV2019 08 2924 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio:

PARCEL ONE:

Known as being a part of Tract 1, formerly Tallmadge Township, and is also known as being all of Lot No. Forty-six (46) in the Select Allotment No. 2, as unrecorded allotment, and is further bounded and described as follows:

Beginning at a point in the Southerly line of Big Falls Avenue. Said beginning point being North 84 deg. 18' East, 99.60 feet from the point of intersection of said Southerly line of Big Falls Avenue, with the East line of Portage Township; thence South 16 deg. 01' West, 101.17 feet; thence North 81 deg. 18' West, 35.90 feet; thence North 9 deg. 02' East, 87.92 feet to the Southerly line of Big Falls Avenue; thence North 84 deg. 18' East, 49.80 feet to the place of beginning and containing 9/100 of an acre. Grantors reserving the right to allot and call the above parcel of land, Lot No. Forty-six (46) of the Select Allotment No. 2, be the same more or less, but subject to all legal highways.

Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio, and being a part of Tract 1, formerly Tallmadge Township, and is also known as being all of Lot No 48 and a part of Lot No. 49 in the Select Allotment No. 2, an unrecorded allotment, and being the same premises deeded to Flora Theiss by deeds recorded in Volume 564, Page 71 and Volume 533, Page 523 of Summit County Records and more fully described as follows:

Beginning at a point in the East line of Meriline Avenue, which line is the line between Portage and Tallmadge Townships, at a point 76.45 feet Southerly from the South line of Grant Street, formerly Big Falls Avenue; thence South 81 deg. 18' East along the Northerly line of said Lots No. 48 and 49 about 97.15 feet to the Northwest corner of land owned by P. and H. Unkelbach; thence Southwesterly in a straight line along said Unkelbach's Westerly line, to a point in the North line of May Avenue, which point is distant 49.70 feet Southeasterly along the North line of said May Avenue from the intersection of the Northerly line of said May Avenue with the East line of Meriline Avenue; thence Northwesterly along the Northerly line of May Avenue 49.70 feet to the East line of Meriline Avenue; thence Northerly along the East line of said Meriline Avenue 76.45 feet to the place of beginning and containing about .160 of an acre. Grantors reserve the right to allot and plat the above described premises and to number the same as Lot No. Forty-eight (48) and part of Lot No. Forty-nine (49) in the Select Allotment No. 2, be the same more or less, but subject to all legal highways, together with the Grantors interest in the Northerly one-half (1/2) of May Avenue above mentioned adjacent to the above described premises on the South.

Property appraised at: Ninety-six Thousand Dollars ($96,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 14th day of February, 2020. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
