By virtue of an Order of Sale No. CV2016 09 4042 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 14TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

Being a part of Original Lot 1 in Tract 15, formerly Tallmadge Township, and more fully described as follows:

Beginning at a point on the Westerly line of Alaho Street which point bears N. 00 degrees 32' W., a distance of (150.05) feet from the point of intersection of the extensions of the Northerly line of Briner Avenue and the Westerly line Alaho Street as indicated on the dedication plat which is recorded in Plat Book 40, Pages 23 to 26, inclusive of the Summit County Record of Plats; thence S. 89 degrees 28' W., a distance of (117.29) feet to a point; thence N. 00 degrees 44' 35" E., a distance of (50.01) feet to a point; thence N. 89 degrees 28' E., a distance of (116.17) feet to a point on the Westerly line of Alaho Street; thence S. 00 degrees 32' E., along the Westerly line of Alaho Street, a distance of (50.00) feet to the place of beginning as determined in May 1, 1956 by Emmet J. McDonald, Registered Surveyor. Be the same more or less, but subject to all legal highways.

Property appraised at: Sixty-six Thousand Dollars ($66,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 28th day of February, 2020. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
