By virtue of an Order of Sale No. CV2008 08 5937 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the County of Summit, in the State of Ohio and in the Township of Coventry and bounded and described as follows:

And known as being a part of Lot No. 1-Tract No. 14, Middle Division and more fully described as follows, to-wit:

Commencing at the center line intersection of the Akron Massillon Road now known as Manchester Road and the New Portage Uniontown Road now known as State Street and thence along the center line of the New Portage Uniontown Road South 34 deg. 19 min. East, 832.75 feet to a point; thence along the South line of lands now or formerly owned by Samuel M. Bower as described in Vol. 309, Pg. 154, South 86 deg. 35 min. East, 485.79 feet to an iron stake and the true place of beginning; thence South 86 deg. 35 min. East, 375 feet to the center of a proposed 50 feet street; an iron pipe is set North 86 deg. 35 min. West, 25.0 feet from this point; thence along the said street center South 3 deg. 25 min. West, 106.29 feet; an iron pipe is set N. 86 deg. 35 min. West, 25.0 feet from this point; thence North 86 deg. 35 min. West, 375.00 feet to an iron stake; thence North 3 deg. 25 min. East, 106.29 feet to the place of beginning and containing approximately 0.915 acres; reserving a parallel strip of land 25 feet in width off of the East side of the above described premises to be used in common with others for street purposes only, also reserving the right to number the above described parcel of as Parcel No. 17 of an unrecorded allotment to be known as Avalon Hills said premises are subject to all legal highways.

Prior Deed Reference: Deed from the Estate of Shelby J. Baldwin aka Shelby Jean Baldwin to Dale L. Baldwin, recorded July 1, 2004 as Instrument No. 55069903.

Property appraised at: Ninety-six Thousand Dollars ($96,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 27th day of October, 2017. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
