By virtue of an Order of Sale No. CV2014 10 4644 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 13TH DAY

OF OCTOBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Green, County of Summit and State of Ohio:

And known as being part of the Southeast quarter of Section 27 in said township and more fully described as follows:

Commencing at the intersection of the centerline of Massillon Road (S.R. 241-60 feet wide) with the said Southeast quarter of Section 27; thence S. 2 deg. 25' 30" E., along the centerline ofs aid road, 1102.11 feet to an angle point; thence S. 12 deg. 42' 30" E., continuing along the centerline of said road, 647.88 feet to the true place of beginning of land hereby described; thence S. 87 deg. 10' E., 550.01 feet to an iron pipe; thence S. 12 deg. 42' 30" E., parallel to the centerline of said Massillon Road, 288.35 feet to an iron pipe in the South line of Grantor's lands; thence N. 87 deg. 15' 20" W., along said Grantor's South line, 148.28 feet to an iron pipe; thence N. 1 deg. 40' 40" E., 36.16 feet to an iron pipe; thence N. 87 deg. 10' W., 407.37 feet to the centerline of said Massillon Road; thence N. 12 deg. 42' 30" W., along the centerline of road, 251.88 feet to the true place of beginning and containing, as surveyed in May 1972 by Swigart & Moore, 3.2519 acres of land.

Property located at: 5001 Massillon Road, North Canton, OH 44720.

Property appraised at: Four Hundred Eighty Thousand Dollars ($480,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 27th day of October, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
