By virtue of an Order of Sale No. CV2017 01 0361 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 20TH DAY

OF OCTOBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Tallmadge, County of Summit and State of Ohio:

And known as being a part of Lot No. 16 in the Tallmadge Crest Allotment as recorded in Plat Book 36, Pages 57 and 58 of Summit County Records of Plats, and further bounded and described as follows:

Beginning at a point of intersection of the South line of Van Evera Road (60.00 feet wide) and the East line of Carruthers Road (60.00 feet wide) as recorded on the plat of said Tallmadge Crest Allotment and thence S. 01 deg. 01' 00" W., along the East line of said Carruthers Road, a distance of 20.00 feet to an iron pin set and the true place of beginning; thence containing S. 01 deg. 01' 00" W., along the East line of said Carruthers Road, a distance of 126.14 feet to an iron pin set; thence S. 88 deg. 59' 00" E., a distance of 150.00 feet to an iron pin set; thence N. 01 deg. 01' 00" E., a distance of 146.14 feet to an iron pin set on the South line of said Van Evera Road; thence N. 88 deg. 59' 00" W., along the South line of said Van Evera Road, a distance of 130.00 feet to an iron pin set at the point of curve to the left; thence on a curve to the left having a central angle of 90 deg. 00' 00", a radius of 20.00 feet, a tangent of 20.00 feet, a chord of 28.28 feet bearing S. 46 deg. 31' 00" W., a length of 31.42 feet to the true place of beginning and containing 21,835.16 square feet, or 0.5013 acres of land as surveyed by Fred H. Bliss, Registered Surveyor No. 4669, February 12, 1990. Except for a private water line easement over, upon and beneath the surface of the West fifteen (15) feet of the premises is herein conveyed which is granted to Joseph D. Bailey, his heirs and assigns. Said easement is granted to Joseph D. Bailey, his heirs and assigns, subject to Joseph D. Bailey, his heirs and assigns, installing and maintenance said private water line without disrupting the ingress or egress over the driveway located on the premises described herein. The cost of repair, landscaping, and any other expenses in the returning the land to its present condition caused by the installation and maintenance of said private water line shall be the sole and exclusive responsibility of Joseph D. Bailey, his heirs and assigns.

Property appraised at: One Hundred Twenty-six Thousand Dollars ($126,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 3rd day of November, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
