By virtue of an Order of Sale No. CV2017 05 2142 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 20TH DAY

OF OCTOBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Village of Lakemore, County of Summit and State of Ohio:

And known as being part of Sub Lots 27-29 and all of Sub Lot 32 of the Springfield Lake Heights Allotment as recorded in the Summit County Record of Plats, Book 14, Page 38 and further described as follow:

Beginning at the Southwest corner of Sub Lot 29 at an iron pin found, number five rebar and cap: ID C. & A. said pin being the true place of beginning for the parcel herein to be conveyed; thence with the Westerly line of Sub Lot 29, N. 00 deg. 23' 40" E., a distance of 57.50 feet to a survey monument set; thence traversing Sub Lots 27 thru 29 S. 75 deg. 22' 00" E., a distance of 123.00 feet to a survey monument set on the East line of Sub Lot 27; thence with the Easterly line of said Sub Lot 27, S. 00 deg. 23' 40" W., a distance of 93.50 feet to a survey monument found at the Southeast corner Sub Lot 32; thence with the South line of said sub lot, N. 75 deg. 22' 00" W., a distance of 102.50 feet to a survey monument found; thence with the Westerly line of said sub lot, N. 00 deg. 23' 40" E., a distance of 36.00 feet to a survey monument found at the Northwest corner of Sub Lot 32; thence with the Southerly line of Sub Lot 29, N. 75 deg. 22' 00" W., a distance of 20.50 feet to a survey monument found, and the true point of beginning. The above tract has the following utility easement:

Beginning at the Northwest corner of Sub Lot 29 and the true place of beginning; thence with the Northerly line of Sub Lot 29, S. 75 deg. 22' 00" E., a distance of 20.00 feet to a point; thence S. 00 deg. 23' 40" W., a distance of 85.50 feet to a point; thence N. 75 deg. 22' 00" W., a distance of 20.00 feet to a survey monument set; thence with the Westerly line of said lot N. 00 deg. 23' 40" E., a distance of 85.50 feet to the place of beginning, containing 0.0381 acres of land. The above described tract of land contains 0.2395 acres 10431.9 square feet, of land, more or less, and is subject to legal highways, easements and restrictions of record if any. All pins set are number five rebar and cap with I.D. Cappelli 7571 as surveyed and determined from local deeds and monumentation in September of 2002, by Robert R. Cappelli. All pins found are number five rebar and cap with I.D. C.&A. unless noted otherwise. Bearings are to an assumed meridian and are used to denote angles only.

Property appraised at: Sixty-six Thousand Dollars ($66,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 3rd day of November, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
