By virtue of an Order of Sale No. CV2017 04 1573 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 3RD DAY

OF NOVEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Stow, County of Summit and State of Ohio:

And known as being a part of Lot No. 85 in said city and more fully described as follows:

Commencing at the Northwest corner of Lot No. 196 of Meadowbrook Lake Allotment No. 1 as recorded in Plat Book 42, Pages 9 and 10, Summit County Record of Plats; thence N. 0 deg. 23' 45" W. along the West line of said allotment produced Northerly, 537.41 feet to the center line of Mac Drive, formerly known as Oak Drive, (a proposed 50 foot street); thence due East along the center line of said drive, 412.76 feet to a point of curve in said center line; thence along the arc of a curve convex to the Northeast, the radius being 525.00 feet, central 66 deg. 00', the chord bearing S. 57 deg. 00' E., 571.87 feet, an arc of 604.76 feet; thence S. 24 deg. 00' E., 124.05 feet to a point of curve; thence along the arc of curve convex to the Southwest, the radius being 1330.00 feet, central angle 32 deg. 45' 01, the chord bearing S. 40 deg. 22' 30" E., 749.92 feet; thence N. 33 deg. 14' 59" E., 25.00 feet to an iron pipe in the Northern line of Mac Drive and the true place of beginning of the parcel herein described; thence N. 33 deg. 14' 59" E., 250 feet to an iron pipe; thence S. 59 deg. 09' 54" E., 88.90 feet to an iron pipe; thence S. 28 deg. 25' 13" W., 250 feet to an iron pipe in the Northern line of Mac Drive; thence along the Northern line of Mac Drive, formerly Oak Drive, following a curve convex to the Southwest, the radius being 1305 feet central angle 4 deg. 49' 46", the chord bearing N. 59 deg. 09' 54" W., 109.97 feet, an arc distance of 110 feet to the true place of beginning and containing 0.57 acres of land. Reserving the right to allot the property of which the foregoing parcel is a part and to designate this as Lot No. 313. Also granting the use for street and roadway purposes of said Mac Drive, formerly known as Oak Drive, Mac Drive mentioned above (formerly known as Oak Drive) is a private road and not a public highway in the unrecorded section of Meadowbrook Lake Allotment. Grantors also grant the right and permission to use in common with other lot owners; Lots No. 164 and 196 in the Meadowbrook Lake Allotment No. 1 as recorded in Plat Book 42, Pages 9 and 10, Summit County Records of Plats and Lot 197 fronting on Meadowbrook Lake and Mac Drive a private road and not a public highway in Meadowbrook Lake Allotment No. 2, the plat of which is unrecorded and the use of Meadowbrook Lake in common with other lot owners for the purposes of boating, fishing, swimming and other recreational pursuits in Meadowbrook Lake in common with other lot owners and the right of access to and egress from said Meadowbrook Lake over and across the front adjoining land of the Grantors.

Property located at: 1453 Mac Drive, Stow, OH 44224.

Property appraised at: One Hundred Seventy-one Thousand Dollars ($171,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 17th day of November, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
