By virtue of an Order of Sale No. CV2017 05 1771 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 3RD DAY

OF NOVEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio:

And known as being a part of Lot 14 in the Warner's Corner Allotment, as recorded in Plat Book 32, Pages 50-52 of Summit County Records of Plats, further bounded and described as follows:

Beginning at the Southeast corner of said Lot 14 in the West line of Oakwood Drive; thence West, along the South line of said Lot 14, a distance of 138.16 feet to a point; thence North, parallel to the West line of said Lot 14, a distance of 51.34 feet to a point; thence S. 89 deg. 27' E., along a line at right angles to the East line of said Lot 14, a distance of 138.64 feet to a point in the East line of said Lot 14, in the West line of said Oakwood Drive; thence S. 0 deg. 33' W., along the East line of said Lot 14 and the West line of Oakwood Drive, a distance of 50.01 feet to the place of beginning, be the same more or less, but subject to all legal highways.

Property located at: 3132 Oakwood Drive, Cuyahoga Falls, OH 44221.

Property appraised at: Seventy-eight Thousand Dollars ($78,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 17th day of November, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
