By virtue of an Order of Sale No. CV2017 05 1835 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 17TH DAY

OF NOVEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Barberton, County of Summit and State of Ohio:

Known as being a part of Lot Number 314 in the Boulevard Heights Allotment as recorded in Plat Book 24, Pages 28 to 31 inclusive and more particularly described as follows:

Beginning at the Southwesterly corner of Lot No. 314; thence Northwesterly along the Northeasterly line of Central Avenue and the Southwesterly line of Lot No. 314, 38 feet to the place of beginning of land to be conveyed; thence continuing Northwesterly on said line, 84 feet to the intersection of the Northeasterly line of Central Avenue with the Southeasterly line of State Street; thence Northeasterly along the Southeasterly line of State Street, 50 feet to the Northeasterly corner of Lot No. 314; thence Southeasterly along the Northeasterly line of said Lot No. 314, 89.65 feet to a point; thence Southwesterly on a line parallel with the Southeasterly line of said Lot No. 314, 50 feet to the place of beginning. Commencing at the Southwesterly corner of said Lot 314, said point being 32.86 feet to the right of station 90 + 77.94 on the centerline of right of way of State Street, said point also being the true place of beginning of the parcel of land hereinafter described; thence clockwise along the following 4 courses and distances; thence along the existing Easterly point of way of State Street (60 feet wide) North 36 deg. 59' 44" East for a distance of 3.62 feet to a point; thence continuing along the said right of way line, North 27 deg. 36' 01" East for a distance of 12.45 feet to a point; thence along the arc of a curve to the left having the following properties: Delta = 83 deg. 35' 26", Radius = 18.00, Tangent = 16.09, Chord = 23.99, Chord Bearing = S. 14 deg. 11' 42" East for a distance of 26.26 feet to a point on the Northerly right of way line of Central Avenue (50 feet wide); thence along said right of way line, North 55 deg. 59' 25" West for a distance of 16.69 feet to the true place of beginning as surveyed under the supervision of L. Terry Frease, P.S. Number 5917 for GPD Associates in November, 1990. Subject to and together with all easements, restrictions and legal highways, if any, of record. Being the same property conveyed to Felicia L. Benedum, by deed, dated January 29, 2004, recorded on February 20, 2004 in 55013189 of the Summit County, Ohio records.

Property appraised at: Sixty-six Thousand Dollars ($66,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 1st day of December, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
