By virtue of an Order of Sale No. CV2017 01 0176 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Known as and being all of Lot 79 in the Pine Lake Allotment #2 as recorded in Plat Book 69, Pages 54-56 of the Summit County Records of Plats.

Known as and being part of Tract 7 in said township and more fully described as follows:

Beginning at an iron pipe found at the most Northerly corner of Lot 79 in Pine Lake Allotment No. 2 as recorded in Plat Book 69, Pages 54-56, Summit County Records of Plats; thence S. 43 deg. 49' 49" W., along the Northwesterly line of said allotment, 185.00 feet to a point in the Northeasterly line of Lot 78 in said allotment; thence N. 46 deg. 10' 11" W., along the Northeasterly line of said Lot 78 and a Southwesterly line of Pine Lake Trail Extension (50 feet wide), 87.63 feet to an iron pipe set; thence N. 43 deg. 49' 49" E., 50.00 feet to an iron pipe set in the Northeasterly line of said Pine Lake Trail Extension; thence N. 14 deg. 20' 02" E., 117.86 feet to an iron pipe set in the Southerly line of a parcel Woodliff by deed recorded in Volume 6417, Page 480 (Parcel II), Summit County Records of Deeds; thence S. 77 deg. 02' 31" E., along the said Southerly line of Woodliff lands, 80.60 feet to an iron pipe found at the most Westerly corner of Lot 80 in said Pine Lake Allotment No. 2; thence S. 39 deg. 30' 11" E., along a Southwesterly line of said lot, 77.00 feet to the place of beginning and containing, as surveyed in October 1992 by Swigart & Moore, 0.4729 of an acre of land. Reserving from the above described 0.4729 acre parcel, the Southwesterly 50 feet for roadway purposes, (the Westerly extension of Pine Lake Trail). Assignment from Sinclair Refining Company to Sinclair Pipe Line Company, dated December 14, 1950 and recorded January 24, 1951 in Volume 2733, Page 465 of the Summit County Official Records. Easement from Pine Lake Development Company to Ohio Edison Company, dated May 28, 1968 and recorded June 5, 1968 in Volume 4790, Page 363 of the Summit County Official Records. Right-of-way to the Tide-Water Pipe Company, Limited, dated November 30, 1908 and recorded in Volume 376, Page 526 of the Summit County Official Records. Said right-of-way was assigned in Volume 5000, Page 513 of the Stark County Official Records. Easement to the Ohio Edision Company, as set forth in an instrument dated December 19, 1946 and recorded in Volume 2335, Page 310 of the Summit County Official Records. Easement & Restrictions set forth in a deed from Paul A. Weber and Paul B. Lemmon, dated October 15, 1964 and recorded in Volume 4389, Page 138 of the Summit County Official Records. Oil & Gas Lease to Seagull Development Corporation, as set forth in an instrument dated February 21, 1986 and recorded in Volume 7123, Page 441 of the Summit County Official Records. Reservation for roadway purposes set forth in a deed from John F. White, widower, and John M. Moore, married, to Edward Branney and Peggy Branney, dated June 1, 1989 and recorded in Volume 283, Page 795 of the Summit County Official Records. Further subject to all covenants, conditions, restrictions, reservations and encumbrances of record and further subject to applicable zoning and all legal highways.

Property appraised at: One Hundred Thirty-five Thousand Dollars ($135,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 22nd day of December, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
