By virtue of an Order of Sale No. CV2016 10 4576 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 8TH DAY

OF DECEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the State of Ohio, County of Summit and City of Tallmadge, and known as being part of Original Lots 2, Tract 7 (formerly Tallmadge Township) and also known as part of a parcel conveyed to Gerald J. Mosley, Jr. as recorded in Reception No. 54377411 of the Summit County Recorders and being further described as follows:

Beginning at a 5/8 inch rebar found at the Northwest corner of Lot 18 in Park Estates Allotment (Plat Book 45, Page 112) and being in the Southerly right-of-way line of Howe Road 60' R/W; thence North 89 deg. 18 min. 35 sec. West, 180.00 feet along the South line of said Howe Road, to the Northwest corner of a parcel conveyed to D. W. and L. M. Griffin as recorded in D.V. 6670, Page 678; thence South 18 deg. 20 min. 07 sec. West, 36.72 feet along the West line of said Griffin Parcel (passing over a 1/2" pipe found at 0.19 feet) to a 5/8" rebar w/I.D. cap set at a Southeast corner of a parcel conveyed to the State of Ohio; thence North 89 deg. 18 min. 35 sec. West, 102.89 feet along said South line, to the true place of beginning of the parcel hereinafter described; thence South 22 deg. 31 min. 26 sec. West, 276.93 feet, along a new division line to a 5/8" rebar with I.D. cap set; thence South 89 deg. 18 min. 35 sec. East, 110.57 feet along a new division line to a 5/8" rebar with I.D. cap set in the Westerly line of the aforementioned Park Estates Allotment; thence South 45 deg. 07 min. 21 sec. West, 243.59 feet, along the West line of said allotment and the West line of a parcel conveyed to G. L. and D. L. Dantz (O.R. 67, Page 294) to a 5/8" rebar with I.D. cap set; thence along the lands of Dantz the following 2 courses:

1. North 89 deg. 18 min. 35 sec. West, 102.16 feet to a 5/8" rebar with I.D. cap set;

2. Thence North 21 deg. 59 min. 17 sec. East, 462.60 feet, to a 5/8" rebar with I.D. cap set in Southerly line of the aforementioned State of Ohio Parcel (witness a drill hold found North 21 deg. 59 min. 17 sec. East, 37.56 feet in the Southerly line of Howe Ave., as the Northeast corner of said Dantz Parcel);

Thence South 89 deg. 18 min. 35 sec. East, 97.08 feet, along said South line to the true place of beginning and containing 1.178 acres of land, more or less, as determined by a survey made under the direction of Stephen P. Campbell, P.S. 7330 of Campbell & Associates, Inc., in March 2000. All rebars set are 30 inches in length with I.D. cap 7330. The basis of bearings for the above description is State Plane Grid North, Ohio North Zone.

Property located at: 372 E. Howe Road, Tallmadge, OH 44278.

Property appraised at: One Hundred Sixty-eight Thousand Dollars ($168,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 22nd day of December, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
