By virtue of an Order of Sale No. CV2016 09 3971 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

And known as being part of Original Lot 13, West of Portage Path, formerly Portage Township, further bounded and described as follows, to-wit:

Beginning at the point of intersection of the West line of Delia Park No. 2 and the center line of Peckham Street, as recorded in Plat Book 35, Page 43 of Summit County Records, the same point being North 0 deg. 30' 30" East, 1029.54 feet along the West line of Delia Park No. 2 from the center line of Copley Road; thence South 0 deg. 30' 30" West along the West line of Delia Park No. 2 Allotment, 25.00 feet to the true place of beginning for the within described parcel; thence North 89 deg. 30' 00" West along a line parallel to the center line of Peckham Avenue produced Westerly, 100 feet to a point; thence South 0 deg. 30' 30" West, parallel to the Westerly line of Delia Park No. 2 Allotment, 173 feet to a point; thence South 89 deg. 30' 30" East, parallel to the center line of said Peckham Avenue produced Westerly 100 feet to a point; thence North 0 deg. 30' 30" East, along the Westerly line of Delia Park No. 2 Allotment, 173.00 feet to the place of beginning, be the same more or less, but subject to all legal highways.

Property appraised at: Sixty-six Thousand Dollars ($66,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 9th day of February, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
