By virtue of an Order of Sale No. CV2017 07 2973 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 9TH DAY

OF FEBRUARY, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being Lot 523 in Elm Hill Estates Company's Allotment as shown by the recorded plat of said allotment in Plat Book 28, Pages 50 to 57 inclusive, Summit County Records of Plats. Excepting the South 7 feet therefrom and excepting that part of Lot No. 523 bounded and described as follows, to-wit:

Beginning at the Northwest corner of said Lot No. 523 and in the Southerly line of Thorndale Drive; thence Northeasterly along the Northwest line of said Lot No. 523 and the Southerly line of said Thorndale Drive, a distance of 49.44 feet to a point; thence Southerly parallel to the East line of said Lot 523, a distance of 100.36 feet to a point in the Southwest line of said Lot No. 523, which point is 7.00 feet Northwest of the South-West corner of said Lot No. 523; thence Northwesterly along the Southwest line of said Lot No. 523, a distance of 87.40 feet to the place of beginning. Be the same more or less, but subject to all legal highways, as surveyed by W. S. Mathews in August 1942.

Property appraised at: One Hundred Twenty Thousand Dollars ($120,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 23rd day of February, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
