By virtue of an Order of Sale No. CV2017 02 0678 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 23RD DAY

OF FEBRUARY, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being a part of a three acre piece of land formerly a part of Tract No. 6 of Portage Township, in said county conveyed by Daniel and Mary Holibaugh to Godfrey Yeater on the 2nd day of November, 1909 by warranty deed recorded in Volume 384, Page 435 of the records of Summit County, Ohio; the land hereby conveyed being more fully described as follows:

Beginning at the Southwest corner of lot of land conveyed by Godfrey Yeater to Fred J. and Augusta C. Schmitz on August 13, 1923, by warranty deed recorded in Volume 970, Page 619 of the records of Summit County, Ohio; said beginning point also being found as follows:

Beginning at the Southeast corner of Lot 267 in the Daniel Allotment as recorded in Plat Book 16, Page 16 of Summit County Records, which is also in the North line of Villa Avenue; thence East along the North line of Villa Avenue, 230 feet to the beginning point of premises herein described; thence Northerly along the West line of said Schmitz land 107 feet to a point; thence Westerly along a line parallel to the South line of the aforesaid 3 acre piece of land 46 feet to a point; thence Southerly along a line parallel to the West line of said Schmitz land to the South line of the aforesaid 3 acre piece of land; thence Easterly along the South line of said 3 acre parcel of land 46 feet to the place of beginning, be the same more or less, but subject to all legal highways.

Prior Deed Reference: Instrument No. 5446317 on May 26, 2000.

Property located at: 721 Villa Avenue, Akron, OH 44310.

Property appraised at: Nine Thousand Dollars ($9,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $2,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 9th day of March, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
