By virtue of an Order of Sale No. CV2017 07 3060 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 2ND DAY

OF MARCH, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

PARCEL 1:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being the East 65 feet Arlington No. 1 Sublot No. 78 of the V. D. Emmons Trustee Allotment as shown by the recorded plat of said allotment in the Recorder's Office of Summit County, Ohio in Volume 14 of Maps at Page 18.

Excepting therefrom the following described premises:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being a part of Lot 78 in the Arlington No. 1 Allotment made for V. D. Emmons Trustee, as recorded in Plat Book 14, Page 18 of Summit County Records, further bounded and described as follows:

Beginning at the Northeast corner of said Lot 78; thence Southerly along the East line of said Lot 78, a distance of 23.58 feet to a mark set in sidewalk; thence Westerly parallel to the North line of said Lot 78, a distance of 65 feet to an iron pipe; thence Northerly parallel to the East line of said Lot 78, a distance of 23.58 feet to an iron pin in the North line of said Lot 78; thence Easterly along the North line of said Lot 78, a distance of 65 feet to the place of beginning, be the same more or less, but subject to all legal highways, as surveyed by W. S. Mathews in May 1957. Subject to restrictions, easements and limitations of record.

And known as being a part of Lot 78 in the Arlington No. 1 Allotment made for V. D. Emmons Trustee, as recorded in Plat Book 14, Page 18 of Summit County Records, further bounded and described as follows:

Property appraised at: Twelve Thousand Dollars ($12,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 16th day of March, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
