By virtue of an Order of Sale No. CV2016 08 3690 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 13TH DAY

OF APRIL, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron (formerly Township of Spingfield), County of Summit and State of Ohio:

Consisting of Two (2) Parcels of land:

PARCEL 1:

And known as Lot Number Forty-seven (47) in the Springfield Terrace Annex Allotment as recorded in Plat Book 13, Page 14, of Summit County Records of Plats. Subject to restrictions and conditions of said allotment.

PARCEL 2:

And known as being a part of Original Lot Number 2, Tract Number 6, formerly Springfield Township and more fully described as follows:

Beginning at an iron pipe at the Northwest corner of Lot 47 of the Springfield Terrace Annex as recorded in Plat Book 13, Page 14 of the Summit County Record of Plats; thence N. 04 deg. 00' E., parallel with the Easterly line of Tract 6, a distance of (152.01) feet to an iron pipe on the Southerly line of the May Forest Allotment as recorded in Plat Book 40, Page 35 of the Summit County Record of Plats; thence S. 81 deg. 34' E. along the Southerly line of the May Forest Allotment, a distance of (39.12) feet to an iron pipe; thence S. 04 deg. 00' W., parallel with the Easterly line of Tract 6, a distance of (148.08) feet to an iron pipe at the Northeasterly corner of Lot 47 of the Springfield Terrace Annex; thence N. 87 deg. 11' W. along the Northerly line of Lot 47, a distance of (39) feet to the place of beginning as surveyed in April 1949 by Emmet J. McDonald, Registered Surveyor

Property located at: 2611 Ellet Avenue, Akron, OH 44312.

Property appraised at: Seventy-two Thousand Dollars ($72,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 27th day of April, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
