By virtue of an Order of Sale No. CV2017 06 2415 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

Situated in the Township of Richfield, County of Summit and State of Ohio:

Being part of Lot 5, Tract 1 of said township, more particularly described as follows:

Beginning at a spike in the road as the intersection of the center line of the Cleveland-West Richfield Rd. (Route #176) South of the county line and the center line of Hills Rd. (which is also the North line of Summit County). This point is S. 89 deg. 45' E., 31.01 ft. along the center line of the Boston-Mills Rd. from an iron monument set at the intersection of the center line of said road and the center line of Route #176 North of the county line; thence along the center line of the Cleveland-West Richfield Rd. S. 28 deg. 11' 30" E., 1130.67 ft. to a spike at the Northwest corner of M. Tibbits property, which point is the beginning of the parcel about to be described. (An iron pin is set N. 88 deg. 05' 25" E., 33.45 ft. from this point); thence along Tibbits' North line and the South line of E. Luther, N. 88 deg. 05' 25" E., 307.56 ft. to an iron pin; thence along the fence line between Tibbits and Luther N. 0 deg. 49' E., 175.81 ft. to an iron pin at a stock fence corner; thence along said stock fence line N. 84 deg. 05' 55" E., 450.79 ft. to an iron pin at a stock fence corner; thence S. 1 deg. 34' 15" E., 645.32 ft. to an iron pin at the intersection of a stock fence and Tibbits South line fence; thence along Tibbits South line and the North line of L. Neff N. 89 deg. 48' 05" W., 473.75 ft. to an iron pin at L. C. Gildea's Southeast corner; thence along Gildea's East line N. 0 deg. 40' 30" E., 258.02 ft. to an iron pin; thence along Gildea's North line N. 89 deg. 59' 30" W., 223.24 ft. to a spike in the center line of the Cleveland-West Richfield Rd. (An iron pin was found S. 89 deg. 59' 30" E., 34.40 ft. from this point); thence along the center line of Cleveland-West Richfield Rd. N. 28 deg. 11' 30" W., 173.58 ft. to the place of beginning. Containing 7.5468 acres more or less as surveyed by E. A. Hand in Jan. 1947 and subject to all legal highways.

Beginning at an iron pin found in the intersection of the North line of Lot 5, Richfield Township and the centerline of S.R. 13 (Luther Road) with the centerline of S.R. 176 Broadview Road); thence S. 23 deg. 12' 40" E., along the centerline of S.R. 176, a distance of 1597.38 ft. to a point; thence S. 89 deg. 46' 38" E. along the North line of the property of W. F. Witlip, a distance of 80.7 ft. to an iron pin found in the true place of beginning; thence N. 0 deg. 41' 15" E., along the East line of the property now in the name of K. A. and M. M. Hostetler, a distance of 258.56 ft. to an iron pin found; thence S. 89 deg. 58' 43" E., a distance of 464.22 ft. to an iron pin set in the West line of the property now in the name of W. F. and M. A. Victor; thence S. 1 deg. 24' 52" E. along the West line of Victor, a distance of 260.29 ft. to an iron pin set; thence N. 89 deg. 46' 38" W., along the North line of Witlip, a distance of 473.75 ft. to the true place of beginning and containing 2.792 acres and being subject to all legal highways, as surveyed by John A. Bambeck, Registered Surveyor No. 5141, in September 1975.

Property appraised at: One Hundred Thirty-five Thousand Dollars ($135,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 8th day of June, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
