By virtue of an Order of Sale No. CV2017 10 4262 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 1ST DAY

OF JUNE, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Springfield, County of Summit and State of Ohio and known as being part of Tract 7, of said township and also known as being all of Sub Lot No. 291 and part of 290 of the Lakeview Knolls Allotment (unrecorded) more fully bounded and described as follows:

Beginning at a point in the centerline of Olde Home Road (T.R. 285) 50 feet wide N. 89 degrees 56' 10" W., a distance of 295.00 feet as measured from a railroad spike set at its intersection with the centerline of McAllister Road 50 feet wide; thence continuing along said Old Home Road N. 89 degrees 56' 10" W., a distance of 60.00 feet to a point herein; thence N. 01 degrees 12' 50" W., a distance of 145.00 feet to a 5/8" rebar set (passing over a 5/8" rebar set at 25.01 feet); thence S. 89 degrees 56' 10" E., a distance of 60.00 feet to a 5/8" rebar set; thence S. 01 degrees 12' 50" E., a distance of 145.00 feet (passing over a 5/8" rebar set at 119.99 feet) to the true place of beginning, containing 8,698 square feet or 0.1997 acre of land more or less as surveyed by Gaskill & Associates, Inc., July 1997 but subject to a 25.00 foot strip of land off the South side of the herein described land for road purposes.

Property located at: 2789 Old Home Road, Akron, OH 44312.

Property appraised at: Ninety Thousand Dollars ($90,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 15th day of June, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
