By virtue of an Order of Sale No. CV2016 10 4552 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Village of Richfield, County of Summit and State of Ohio:

And known as being part of Lot 20, Tract 1, formerly Richfield Township and more fully described as follows:

Beginning at the centerline intersection of Humphrey Road (60' right of way) and Brush Road (60' right of way) (T.R. 178); thence South 87 degrees 42 minutes 19 seconds East, along the centerline of said Brush Road, a distance of 1178.23 feet to a point of curve; thence following an arc of a curve to the left, continuing along the centerline of said Brush Road, having a radius of 637.15 feet, a central angle of 26 degrees 39 minutes 25 seconds, a tangent distance of 150.95 feet, a chord distance of 293.77 feet which bears North 78 degrees 57 minutes 59 East, a distance of 296.43 feet to a point of tangency; thence North 65 degrees 38 minutes 16 seconds East, continuing along the centerline of said Brush Road, a distance of 201.64 feet to a point and also being the true point of beginning for the parcel herein described; thence North 65 degrees 38 minutes 16 seconds East, continuing along the centerline of said Brush Road, a distance of 200.00 feet to a point; thence South 00 degrees 11 minutes 23 seconds East, a distance of 165.48 feet to a capped iron pin set; also passing over a capped iron pin to be set at 32.88; thence South 19 degrees 59 minutes 21 seconds East, a distance of 170.00 feet to a capped iron pin set; thence South 14 degrees 38 minutes 48 seconds West, a distance of 407.93 feet to a capped iron pin set; thence South 88 degrees 50 minutes 31 seconds West, a distance of 135.61 feet to a 1 inch open top pipe found; thence North 00 degrees 11 minutes 23 seconds West, a distance of 640.15 feet to the true point of beginning and containing 130.728 square feet or 3.0011 acres of land more or less. Witness an iron pin found 32.98 feet South of the true point of beginning. Said parcel is subject to all easements, restrictions and reservation of records. This description is based on a survey made by Dennis W. Stoffer, Registered Surveyor No. 7604, in December 2001. The basis of bearings for this description is the Forestridge Phase I plat as recorded in Cabinet H, Slides 851 through 854 of the Summit County Record of Plats.

Property appraised at: One Hundred Eighty-three Thousand Dollars ($183,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 22nd day of June, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
