By virtue of an Order of Sale No. CV2017 09 3773 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 15TH DAY

OF JUNE, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Hudson, County of Summit and State of Ohio:

And known as being part of Lot No. 44, formerly Hudson Township, and further described as follows:

Beginning at an iron pin in the North line of Lot No. 44, 1209.56 feet East of the Northwest corner of said lot; thence North 89 deg. 43' 22" East, 215.98 feet along said North line to an iron pin; thence South 22 deg. 27' 30" East, 403.63 feet to a point in the center of the Richfield-Hudson Road, State Route No. 303 and passing over an iron pin at 30.00 feet from last named point; thence South 67 deg. 32' 30" West, 200.00 feet along the center line of said road; thence North 22 deg. 27' 30" West, 485.17 feet, passing over an iron pin at 30.00 feet to the beginning and containing 2.04 acres of land, as surveyed December 29, 1949, by Walter J. Stockman.

Property appraised at: Two Hundred Seventy-six Thousand Dollars ($276,000.00).

"To be sold subject to the mortgage of Defendant Nationstar. Minimum bid shall not be less than 2/3 of the difference between the appraised value of the real estate as appraised and the amount remaining unpaid on the claim or obligation secured by the mortgage in favor of Defendant Nationstar. Appraisal is $276,000.00. Judgment of Nationstar is $203,424.39. $276,000.00 - $203,424.39 = $72,575.61. $72,575.61 x 2/3 = $48,383.74. Opening bid is $48,383.74.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 29th day of June, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
