By virtue of an Order of Sale No. CV2019 08 3012 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio:

And known as being part of Lot No. 1, formerly Stow and bounded and described as follows:

Starting at a point 45 feet Southerly from the North line of a 1.81 acre of land of land formerly owner by Arnos Barton, which point is 160 feet Westerly from a point in the West line of Third Street, which point in the Westerly line of Third Street in Northeasterly 158 feet along the Northwesterly line of North Third Street from the intersection of the Northwesterly line of said North Third Street with the prolongation Northwesterly of the centerline of Wadsworth Street; thence Southerly along the Westerly line of lands now or formerly owned by W. W. Hibbardland Charles Wagner for a distance of 45 feet; thence Westerly parallel with the North line of said Barton Tract and 90 feet distant therefrom and along the Northerly line of Lot No. 126 of the Berkshire Park Allotment as recorded in Plat Book 30, Page 48 of Summit County Records to the Easterly line of Fourth Street extended as conveyed by deed in Volume 560, Page 234 for street purposes; thence Northerly along the Easterly line of Fourth Street extended a distance of 45 feet; thence Easterly and parallel with the Northerly line of said Barton Tract to the place of beginning, be the same more or less, but subject to all legal highways.

Property appraised at: One Hundred Twenty-three Thousand Dollars ($123,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at

https://summit.sheriffsaleauction.ohio.gov on the 30th day of December, 2022. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
