By virtue of an Order of Sale No. CV2023 05 1665to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

And known as being part of Tract Number Thirteen (13), further bounded and described as follows, to-wit:
Beginning at a point in the East line of said Tract Number Thirteen (13), which is in the center line of the Arlington Road, said point North a distance of 656.00 feet from the center line of East Reservoir-Springfield Road; thence North eighty-nine degrees (89 deg.), five minutes (5') West along a line parallel to the center line of said East Reservoir-Springfield Road, a distance of 603.00 feet to a point and the true place of beginning of the land herein described; thence North eighty-nine degrees (89 deg.), five minutes (05') West, along a line parallel to the center line of East Reservoir-Springfield Road, a distance of 90.00 feet to a point; thence North, along a line parallel to the East line of said Tract Number Thirteen (13), a distance of 414.91 feet to a point; thence North eighty-eight degrees (88 deg.) thirty-nine minutes (39') thirty seconds (30") East, a distance of 90.01 feet to a point; thence South, along a line parlallel to the East line of said Tract Number Thirteen (13), a distance of 418.45 feet to the true place of beginning and contains eighty-six hundredths (0.86) acres of land, excepting therefrom a perpetual easement to the State of Ohio as recorded in Volume 4069, Page 619 for public highway and road purposes. Be the same more or less, as surveyed by W. S. Matthews in September, 1939. Reserving the South twenty-five (25) feet of the above described land for road purposes, same to form a part of the North half of proposed Gouglar Road. The appraisal was completed based on an exterior view of the property only.
Property cannot be sold for less than 2/3 of the appraised value.
TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.
If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 9th day of November, 2023. The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).
The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
