By virtue of an Order of Sale No. CV2017 12 5279 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

Situated in the Village of New Franklin, County of Summit and State of Ohio:

And known as being a part of the Northeast quarter of the Southeast quarter of Section 11 in said township and being more fully described as follows:

Beginning at an iron pipe set on the North line of said quarter-quarter section, said beginning point being South 87 deg. 33' East, a distance of 1105.46 feet as measured along said quarter-quarter section line from an iron pipe at the Southwest corner of said quarter-quarter section to the true place of beginning; thence North 15 deg. 17' 54" East, a distance of 197.51 feet to a point on the meanders of the South Shore of Rex Lake as set forth by the U. S. Department of the interior on April 13, 1965 and recorded in Plat Book 46, Page 117 of Summit County Records of Plats. Thence North 69 deg. 00' 00" East, a distance of 71.40 feet; thence South 68 deg. 00' 00" East, a distance of 138.60 feet to a point on the East line of the Southeast quarter of Section 11, Franklin Township; thence South 3 deg. 40' 02" West, a distance of 174.64 feet along the East line of said Southeast quarter to the Southeast corner of the Northeast quarter of the Southeast quarter of Section 11, Franklin Township; thence North 87 deg. 33' West along the South line of the quarter-quarter section line 236.32 feet to the place of beginning, as surveyed by John Michael Johnanyak, Registered Professional Surveyor No. 6183 in February of 1981.

Beginning at an iron pipe set on the North line of said quarter-quarter section, said beginning point being South 87 deg. 33' East, a distance of 808.44 feet as measured along said quarter-quarter section line from an iron pipe at the Southwest corner of said quarter-quarter section line from an iron pipe at the Southwest corner of said quarter-quarter section to the true place of beginning; thence North 42 deg. 6' East along the Southeast line of a parcel of land as deeded to Anthony P. Ross and Iola H. Ross, by instrument recorded in Volume 3482, Page 565 of Summit County Records, a distance of 245.7 feet to a point on the meanders of the South Shore or Rex Lake as set forth by the U.S. Department of the Interior on April 13, 1955 and recorded in Plat Book 44, Page 117 of Summit County Records of Plats. The following four courses are along the South Shore of Rex Lake as delineated on the plat of said South Shore as recorded in Plat Book 46, Page 117 of Summit County Records of follows:

Thence South 55 deg. 00' 00" East, a distance of 92.90 feet; thence South 77 deg. 00' 00" East, a distance of 66.00 feet; thence due North 46.20 feet; thence North 69 deg. 00' 00" East, a distance of 47.40 feet; thence South 15 deg. 17' 54" West, a distance of 197.51 feet to an iron pipe set on said quarter-quarter section line North 87 deg. 33' 00" West, a distance of 297.82 feet to the true place of beginning as surveyed by John Michael Johanyak, Registered Professional Surveyor No. 6181 in February of 1981.

Property appraised at: One Million Eight Hundred Forty-five Thousand Dollars ($1,845,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 8th day of March, 2019. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
