The Eric Conger Irrevocable Inter-Vivos Trust, Eric Conger Trustee, 863 North Cleveland Massillon Road, Akron, Ohio 44333, Plaintiff vs. David Cody, Defendant.

The Plaintiff Trust brought an action for damages against the Defendant. The Defendant in this case is Mr. David Cody, whose last known address is 3048 Oak Hill Road, Peninsula, Ohio 44264 and whose current residence is unknown, whom proper personal service cannot be achieved upon, who has otherwise instructed his counsel of record to refuse service, and otherwise whose whereabouts cannot reasonably be ascertained after the exercise of due diligence, will take notice that on January 4, 2012, The Eric Conger Irrevocable Inter-Vivos Trust, by and through counsel, filed a complaint for past due rent, property damage, and unjust enrichment in the Stow Municipal Court, City of Stow, Summit County, Ohio in the case captioned 12-F-0039 on the docket of the court, and the object and demand for relief in that case is monetary damages and awards form the Defendant in the amount of $8,300.00.

The above named Defendant, if having not already done so, is required to answer within 28 days after the last publication of this notice, which shall be published once a week for three consecutive weeks, or he may be denied a hearing in this case. Please take notice thereof.
