By virtue of an Order of Sale No. CV2010 05 3438 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

The land referred to in this commitment, situated in the Township of Richfield, County Summit, State of Ohio, is described as follows:

Situated in the Township of Richfield, County of Summit and State of Ohio, being a part of Lot 5, Tract 2, Twp. -4N, R-12W and described as follows:

Beginning at the Southwest corner of Lot 5, Tract 2, witnessed by an iron pin found N. 5 degrees 47' 20" E., 30.00 feet; thence with the lines of the Grantors the following ten courses:

1. N. 5 degrees 47' 20" E., 1750.21 feet, along the West line of said lot, being also N. 5 degrees 47' 20" E., 1750.21 feet, along the West line of said lot, being also the Summit-Medina County Line, to an iron pin set;

2. S. 84 degrees 30' 43" E., 2328.33 feet to a point in the Medina Line Road, witnessed by an iron pin found N. 82 degrees 48' 57" W., 29.59 feet;

3. S. 6 degrees 27' 01" W., 130.25 feet, along said road to a spike found witnessed by an iron pin found N. 84 degrees 22' 39" W., 30.02 feet;

4. N. 84 degrees 37' 40" W., 328.02 feet to a point, witnessed by an iron pin found N. 84 degrees 37' 50" E., 0.11 feet;

5. S. 6 degrees 26' 58" W., 641.15 feet to an iron pin set;

Commencing at a 2" round lead filled pipe found at the intersection of the centerline of Medina Lina Road (C.H. 2, 60 feet wide) with the centerline of Hawkins Road (C.H. 185, 60 feet wide), said point also being on the South line of said Lot 5; thence N. 83 deg. 33' 00" W., along the said South line of Lot 5 and centerline of said Hawkins Road, a distance of 477.85 feet to a point, (without an iron pin found N. 83 deg. 18' 28" E., 1.10 feet); thence N. 04 deg. E., a distance of 592.79 feet to an iron pin set and true place of beginning for the parcel herein described; thence N. 83 deg. 33' 02" W., a distance of 305.00 feet to an iron pin set; thence N. 05 deg. 58' 49" E., a distance of 648.56 feet to an iron pin set; thence S. 83 deg. 33' 02" E., a distance of 305.00 feet to an iron pin set; thence S. 06 deg. 26' 58" W., a distance of 230.00 feet to a pipe found at the Southwest corner of lands now or formerly owned by A. R. & F. Machak as recorded in Volume 5501, Page 187 of the Summit County Records; thence S. 84 deg. 41' 30" E., along the South line of said Machak property, a distance of 328.02 feet to a point and passing over an iron pin set at 306.35 feet; thence S. 12 deg. 19' 41" W., a distance of 74.57 feet to a stone found on the West line of said Medina Line Road; thence N. 83 deg. 44' 14" W., along the North line of lands now or formerly owned by B. A. Javorsky as recorded in Volume 4037, Pages 416 and 418 of the Summit County Records, a distance of 325.72 feet to an iron rod found at the Northwest corner of said Javorsky property; thence S. 04 deg. 41' 45" W., along the West line of said Javorsky property, a distance of 350.00 feet to the true place of beginning, based on a survey made by Dean M. Culp, Registered Surveyor No. 6811 in March 1997.

Situated in the Township of Richfield, County of Summit and State of Ohio:

And known as being a part of Lot 5, Tract 2, Township 4N; R-12W and further described as follows:

Beginning at the Southwest corner of Lot 5, Tract 2, witnessed by an iron pin found N. 5 deg. 47' 20" E., 30.00 feet; thence the following four courses:

1. North 5 deg. 47' 20" East, 1750.21 feet, along the West line of said lot, being also the Summit-Medina County Line, to an iron pin set;

2. South 84 deg. 30' 43" East, 250.00 feet along the North line of the Grantors, to an iron pin set;

3. South 5 deg. 47' 22" West, 1754.41 feet to a railroad spike set on the South line of Lot 5 and in Hawkins Road witnessed by an iron pin set North 5 deg. 47' 22" East, 30.00 feet;

4. North 83 deg. 33' 00" West, 250.00 feet, along the lot line and Hawkins Road to the point of beginning as surveyed by Ray W. Gasbarre, P.S. 4153.

Property appraised at: One Million Three Hundred Fifty Thousand Dollars ($1,350,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the date of sale.
