By virtue of an Order of Sale No. CV2018 02 0603 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 16TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

The following described land situated in the City of Barberton, County of Summit and State of Ohio:

Lot #7 in the Heyl Allotment, of record in Summit County Plat Book #43, at Pages 5-6, including the following parcel deeded in the City of Barberton at OR 1212-1.

Commencing at the Southeast corner of said Lot #7, said point being 30.00 feet to the left of Station 66 + 24.53 on the centerline of right-of-way of State Street said point also being the true of beginning of the parcel of land herein described; thence clockwise along the following 3 courses & distances; thence along the Northerly right of way line of Glenn Street, North 58 deg. 31 min. 31 sec. West for a distance of 17.95 feet to a point; thence along the arc of a curve to the left having the following properties:

Delta - 89 deg. 49 min. 47 sec.

Radius - 18.00

Tangent - 17.95, Chord - 25.42

Chord Bearing - North 76 deg. 33 min. 36 sec. East

For a distance of 25.42 feet to a point in the Westerly right of way line of State Street; and thence along said right of way line South 31 deg. 38 min. 42 sec. West for a distance of 17.95 feet to the true place of beginning and containing 69 sq. ft. of land, more or less, as surveyed under the supervision of L. Terry Frease, PS #5917 for GPD Associates, August, 1990.

Property appraised at: Sixty-six Thousand Dollars ($66,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 30th day of November, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
