By virtue of an Order of Sale No. CV2018 03 1271 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 14TH DAY

OF SEPTEMBER, A.D., 2018

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being a part of Tract Number Six (6). Beginning at an iron pipe in the Northerly line of Charles Street which is North 89 deg. 3' East along the Northerly line of Charles Street, two hundred thirty-two and seventy-five hundredths (232.75) feet from its intersection with the East line of Lot Number 16 of the Portage Canal and Manufacturing Company's Allotment, as recorded in Plat Book 1, Page 31, Summit County Records, said beginning point being also two hundred seventy-one and thirty hundredths (271.30) feet West from the intersection of the North line of said Charles Street with the West line of Turner Street; thence North 0 deg. 25' East parallel with the East line of said Lot Number 16, one hundred six (106) feet to an iron pipe; thence South 84 deg, 22' East, sixty-one and three hundredths (61.03) feet to an iron pipe; thence South 0 deg. 25' West, ninety-nine (99) feet to an iron pipe in the North line of Charles Street; thence South 89 deg. 03' West, sixty and eighty hundredths (60.80) feet to the place of beginning and containing as surveyed April 30, 1931 by S. G. Swigart & Son, 0.1430 of an acre of land. Be the same more or less, but subject to all legal highways. Reserving from the above described land a strip eight (8) feet wide to be used in common with owners or tenants of the property next North for driveway purposes. Said eight (8) foot strip to extend from the North line of the above described land to Charles Street and the East line to be coincident with the East line of the above described land.

Property appraised at: Thirty-three Thousand Dollars ($33,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 28th day of September, 2018. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
