By virtue of an Order of Sale No. CV2016 08 3593 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 20TH DAY

OF OCTOBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Green, County of Summit and State of Ohio:

And known as being a part of the Northwest Quarter Section 11, in said township and more fully described as follows:

Beginning at a point in the center line of DeWalt Drive which point is South 2 deg. 42' West, along said center line 940.98 feet from its intersection with the North line of Section 11; thence South 2 deg. 42' West, along the centerline of DeWalt Drive, 50 feet; thence South 87 deg. 18' East, 270 feet; thence South 2 deg. 42' West, 149.30 feet; thence South 87 deg. 18' East, 243.32 feet to an iron pipe; thence North 2 deg. 23' East, 198.61 feet to an iron pipe; thence North 87 deg. 08' 10" West, 512.2 feet to the point of beginning and containing, as surveyed by E. A. Hand in March, 1969, 1.418 acres of land and reserving the West 25 feet of said property for street purposes.

Prior Deed Reference: Instrument recorded on July 13, 1977 in/as Volume 5933, Page 236 and by Affidavit of Confirmation of Transfer upon Death Affidavit, recorded on April 7, 2014 as Instrument Number 56038266 of the Summit County, Ohio.

Property located at: 3167 Dewalt Drive, Akron, OH 44312.

Property appraised at: One Hundred Twenty Thousand Dollars ($120,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 3rd day of November, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
