By virtue of an Order of Sale No. CV2015 01 0034 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 13TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

TRACT NO. ONE:

And known as being part of Tract Four (4) and also a part of the Joseph Wesner-Farm, so called:

Beginning at a point in the center line of the Merriman Road, North 20 deg. 26 min. East, four hundred forty-eight and twenty hundredths (448.20) feet, measured along road center from the South line of the Wesner Farm, so-called; thence South 89 deg. 15 min. West, thirty-two and two tenths (32.2) feet to a pin in the West line of Merriman Road (said pin being South 20 deg. 26 min. West, ninety (90.0) feet measured along the West line of Merriman Road from the intersection of the West line of Merriman Road and the South line of Sunnyside Avenue); thence South 89 deg. 15 min. Beginning at the intersection of the center line of Merriman Road and Sunnyside Avenue (marked by a drill hole); thence South 21 deg. 02 min. 18 sec. West along the center line of Merriman Road, two hundred fourteen and twelve hundredths (214.12) feet to a point, the true place of beginning; thence South 89 deg. 53 min. 30 sec. West along the South line of a 0.56 acre parcel of land deeded by Gertrude V. and W. A. Spencer to Charles M. Kraus, by deed dated September 15, 1925 and recorded in Book 1033, Page 667, Summit County Records, a distance of three hundred three and forty-five hundredths (303.45) feet to a point, said point being the Northeast corner of Lot Number Fifteen (15) of the Spencer Allotment, as recorded in Plat Book 35, Page 35, of Summit County Records; thence South 0 deg. 08 min. East along the East lines of Lots Number Fifteen (15) and Number Sixteen (16) of said allotment, a distance of one hundred three and twenty hundredths (103.20) feet to a point; thence North 89 deg. 53 min. 30 sec. East, a distance of two hundred sixty-three and fifty-two hundredths (263.52) feet to a point in the center line of Merriman Road; thence North 21 deg. 02 min. 18 sec. East along the center line of Merriman Road, a distance of one hundred ten and fifty-seven hundredths (110.57) feet to the true place of beginning.

Property appraised at: Two Hundred Forty-six Thousand Dollars ($246,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 27th day of October, 2017. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
