By virtue of an Order of Sale No. CV2015 07 3410 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:


Situated in the City of Tallmadge, County of Summit and State of Ohio:

And known as being a part of Lot No. 1, Tract No. 6, formerly in Tallmadge Township and more fully described as follows, to wit:

Commencing at the Northeasterly corner of said Lot No. 1, said beginning point being 33 feet Southerly at right angles from the center line of Howe Road; 66 feet in width (said road is also known as Cuyahoga Falls-Brimfield Road) (a marked stone is North 41 deg. 18" West, 3.94 feet from said lot corner) and thence along the Northerly line of said Lot No. 1, South 41' 18" East, 252.24 feet to an iron pipe; thence South 51 deg. 26' 10" West, 359.29 feet to an iron pipe; thence North 67 deg. 38' 30" West, 228.84 feet to an iron pipe at the true place of beginning of land herein described; thence South 51 deg. 26' 10" West, 363.76 feet to an iron pipe on the Northeasterly line of Northwest Avenue, 60 feet in width (said road is also known as Cuyahoga Falls-Mogadore Road; thence along said road line North 38 deg. 50' West, 133.33 feet to a iron pipe; thence at right angles, North 38 deg. 50" East, 289.64 feet to an iron pipe; thence South 67 deg. 38' 30" East, 152.56 feet to the place of beginning and containing 1.00 acre of land as surveyed in August 1950 by Gehres & Kingsley, Surveyors. Be the same more or less, but subject to all legal highways.

Property appraised at: One Hundred Twenty Thousand Dollars ($120,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 3rd day of November, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
