By virtue of an Order of Sale No. CV2017 05 1754 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 8TH DAY

OF DECEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being Lot Number One Hundred Thirty-eight (138) in Preston Heights Allotment First Addition, and also the Northerly three (3) feet to the Westerly forty-eight (48) feet of Lot Number One Hundred Thirty-nine (139) of the Preston Heights Allotment First Addition as per the recorded plat thereof, Plat Book 28, Page 42-45 of Summit County Records.

Commencing for reference at a 3/4" pipe found at the Northeast corner of Lot 137 of said allotment; thence along the South right of way of Brandon Avenue (50') N. 89 deg. 14 min. 00" W., a distance of 40.00 feet to a drill hole in the South edge of concrete sidewalk said point being the Northeast corner of Lot 138 of said allotment and being the true place of beginning of the parcel herein described; thence along the East line of said Lot No. 138 S. 00 deg. 34 min. 10" W., a distance of 75.00 feet to a point on the North line of Lot 139 of said allotment; thence along the North line of said Lot No. 139 and the South line of said Lot No. 138 N. 89 deg. 14 min. 00" W., a distance of 2.00 feet to a 5/8" steel bar set; thence parallel to the East line of said Lot 138, N. 00 deg. 34 min. 10" E., a distance of 75 feet to a drill hole marked in the South edge of the concrete sidewalk being on the South right-of-way of Brandon Avenue (50'); thence along the South right-of-way of Brandon Avenue, S. 89 deg. 14 min. 00" E., a distance of 2.00 feet to the true place of beginning as surveyed by Rex W. Marshall (#6689) in August of 1985.

Property appraised at: Thirty-nine Thousand Dollars ($39,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 22nd day of December, 2017. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
