By virtue of an Order of Sale No. CV2017 05 2001 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 15TH DAY

OF DECEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio, and known as being a part of Lot One Hundred Sixteen (116) in the Eastwood Heights Allotment as recorded in Plat Book 31, Pages 12-18 inclusive, Summit County Records of Plats, and more fully described as follows:

Beginning at the Northwest corner of Lot 116; thence South 0 deg. 43' 30" West, a distance of 187.75 feet along the East line of Alaho to the true place of beginning; thence continuing South 0 deg. 43' 30" West, a distance of 80.00 feet along the East line of Alaho; thence South 88 deg. 09' 30" East, a distance of 138.04 feet to the East line of Lot 116; thence North 2 deg. East, a distance of 79.98 feet along the East line of Lot 116; thence North 88 deg. 09' 30" West, a distance of 139.82 feet to the true place of beginning as determined by Donald H. Caldwell in July 1961.

Property appraised at: Eighty-one Thousand Dollars ($81,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 29th day of December, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
