By virtue of an Order of Sale No. CV2016 12 5118 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 15TH DAY

OF DECEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot Number Five (5) of the Ferdinard Schumacher's Allotment of parts of Lot Number Fifteen (15) and Eighteen (18) West of Portage Path, as surveyed by C. C. Perkins, Surveyor and recorded in Summit County Records of Plats of Book 5, Page 12 and 13 bounded and described as follows:

Beginning at a point in the Northwest corner of said Lot Number 5; thence Easterly along the North line of said lot, forty-five (45) feet; thence Southerly along a line parallel to the West line of said lot, 150 feet; thence Westerly along a line parallel to the North line of said lot, 45 feet; thence Northerly along the West line of said lot, 150 feet to the place of beginning, be the same more or less, but subject to all legal highways.

Excepting therefrom the following described premises:

Situated in the City of Akron, County of Summit and State of Ohio and known as being part of Lot 5 in the Schumacher Allotment, Plat Book 5, Page 12, of the Summit County Records of Plats and being a corner rounding needed for sidewalk purposes more fully described as follows:

The true place of beginning being the Northwesterly corner of said Lot 5; thence Northeasterly along the Southerly line of Copley Road (60' R/W), N. 87 degrees 35' 59" E. (Grid bearing, Ohio Coordinate System), 14.37 feet to a point of curve; thence Southwesterly through Lot 5 and along the arc of a circle curving to the left (center angle 7 degrees 33' 40", radius = 15.00', chord = 20.76', chord bearing = S. 43 degrees 49' 10" W.), 22.92 feet to the Easterly line of Grace Avenue (60' R/W); thence Northeasterly along the Easterly line of Grace Avenue, N. 0 degrees 02' 20" E., 14.37 feet to the true place of beginning for the land hereinbefore described and contained 44 square feet of land surveyed by the City of Akron, Bureau of Engineering in February, 1993.

Property located at: 833 Copley Road, Akron, OH 44320.

Property appraised at: Twenty-one Thousand Dollars ($21,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 29th day of December, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
