By virtue of an Order of Sale No. CV2017 09 3655 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 26TH DAY

OF JANUARY, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio:

And known as being a part of Tract 1 (formerly in Tallmadge) and more fully described as follows:

Beginning at a point in the center line of Magnolia Avenue, Southerly 74 deg. 44' East, 1176.77 feet from the intersection of the center line of Magnolia Avenue, with the center line of Murray Avenue; thence North 15 deg. 16' East, 207.64 feet to a point; thence South 74 deg. 44' East, 84.15 feet to a point; thence South 15 deg. 16' West, 207.64 feet to the center line of Magnolia Avenue; thence North 74 deg. 44' West, 84.15 feet along the center line of Magnolia Avenue to the place of beginning. Reserving a strip of land 22 1/2 feet off the South side of said parcel to be used for street purposes. Reserving the right to plat and lot number Lot No. 199 and 200.

Property appraised at: Eighty-one Thousand Dollars ($81,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 9th day of February, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
