By virtue of an Order of Sale No. CV2017 05 1860 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

Situated in the City of Tallmadge, County of Summit and State of Ohio:

And known as being part of Lot No. 1, Tract 12, formerly Tallmadge Township, and more fully described as follows:

Beginning at a point in the West line of Lot 1, which is also in the East line of South Munroe Road, which point is S. 0 deg. 25' 30" W., a distance of 973 feet from the Northwest corner of Lot No. 1; thence East, a distance of 153.28 feet to an iron pipe and the Southwest corner of lands conveyed to Norman E. Nitzsche and Thera Nitzsche by deed August 1965 and recorded in Volume 4473, Page 120 of Summit County Records; thence North along said Nitzsche's West line, a distance of 92.91 feet to a point in the South line of Timothy Avenue; thence Westerly along the South line of Timothy Avenue distance of 35.90 feet to a point; thence continuing Westerly along the South line of Timothy Avenue, a distance of 92.03 feet to a point of curve; thence by a curve bearing to the left, radius 25.0 feet, central angle 89 deg. 34' 30", a tangent 24.82, an arc distance of 39.08 feet to a point in the West line of Lot 1 and the East line of South Munroe Road; thence South along the West line of Lot 1 and the East line of South Munroe Road, a distance of 65.18 feet to the place of beginning, be the same more or less, but subject to all legal highways.

Commencing at the Northwest corner of Lot No. 1, Tract 12; Course 1: Thence azimuth 181 deg. 47' 39" along the West line of Lot No. 1 and also the East line of South Munroe, 60 feet wide, a distance of 972.28 feet to a No. 5 rebar and I.D. Cap #6541 set flush at the Southeast corner of land conveyed to D. E. & H. Morris by instrument recorded in Deed Book 7133, Page 535, Summit County Records and the true place of beginning of land herein to be described; Course 2: Thence azimuth 91 deg. 25' 44" along the South line of land conveyed to D. E. & H. Morris, a distance of 152.78 feet to a point on the West line of land conveyed to W. B. & M. L. Lance by instrument recorded in O.R. 1054, Page 521, Summit County Records (witness a 1/2" closed top pipe inside a 1 1/2" pipe found 2" high, 0.13 feet North of point described); Course 3: Thence azimuth 181 deg. 47' 39" along the West line of land conveyed to W. B. & M. L. Lance, a distance of 20.00 feet to a #5 rebar and I.D. Cap #6541 set flush; Course 4: Thence azimuth 271 deg. 25' 44", a distance of 152.78 feet to a #5 rebar and I.D. Cap #6541 set flush and on the West line of Lot No. 1 and also the East line of South Munroe Road; Course 5: Thence azimuth 01 deg. 47' 39" along the West line of Lot No. 1 and the East line of South Munroe Road, a distance of 20.00 feet to the place of beginning, but subject to any legal rights or easements of record, as surveyed in July 1992, by John W. Patrick, Jr., Professional Surveyor #6541, be the same more or less, but subject to all legal highways.

Property appraised at: Ninety Thousand Dollars ($90,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 9th day of February, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
