By virtue of an Order of Sale No. CV2016 08 3549 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 2ND DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the State of Ohio, County of Summit and Township of Springfield and being part of Lot 20 of Tract 8 further bounded and described as follows:

Commencing for reference at a solid bar found at the Southwest corner of Lot 20 of Tract 8 of Springfield Township; thence South 87 deg. 00' 00" East along the South line of Lot 20 and along the Westerly extension of the centerline tangent of a roadway curve of Springfield-Mogadore Road (Albrecht Avenue), a distance of 105.66 feet to a point of intersection (P.I.) of said curve and being the true place of beginning of the tract herein described; thence North 48 deg. 00' 30" West, along the centerline forward tangent of said roadway curve and its Northwesterly extension, a distance of 129.45 feet to the Southeast corner of a parcel of land now or formerly owned by Ripley Machine Company (Vol. 5031, Page 39); thence North 03 deg. 03' 47" East, along the East line of said Ripley Machine Company parcel, a distance of 160.57 feet to an iron bar set (and passing over a nail found on the North right of way line of Springfield-Mogadore Road (Albrecht Avenue); thence North 36 deg. 10' 31" East, along the South line of a 0.587 acre parcel now or formerly owned by Ripley Machine Company and previously acquired from W. H. & E. P. Petry, a distance of 61.72 feet to an iron bar set; thence South 86 deg. 13' 09" East, parallel to the North line of said 0.587 acre parcel, a distance of 90.00 feet to an iron bar set on the West line of property now or formerly owned by G. Tippel (Volume 4940, Page 74); thence South 02 deg. 56' 57" West, along the West line of said G. Tippel parcel, a distance of 292.41 feet to a point on the centerline back tangent of Springfield-Mogadore Road; thence North 87 deg. 00' 00" West, along the centerline back tangent, a distance of 23.62 feet to the point of intersection (P.I.) of said centerline curve and being the true place of beginning and containing 0.721 acre, as determined by Rex W. Marshall, P.S. #6690, Uniontown, Ohio in October of 2003. Subject to all legal highways (Springfield-Mogadore Road) Albrecht Avenue. Basis for bearing is the centerline of Springfield-Mogadore Road (Albrecht Avenue) which is North 48 deg. 00' 30" West as obtained from Deed Volume 4157, Page 640.

Property appraised at: Seventy-eight Thousand Dollars ($78,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 16th day of February, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
