By virtue of an Order of Sale No. CV2014 05 2247 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 2ND DAY

OF FEBRUARY, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

TRACT 1:

Situated in the City of Akron, County of Summit and State of Ohio and known as 452 N. Arlington Street, being part of Tract 7 in what was Portage Township but what is now the City of Akron, and described as follows:

Beginning in the West line of Middleberry and Cuyahoga Falls Road 7 chains 63 links North from the North line of Brown's Lots which said place of beginning is Northerly along the West line of North Arlington Street 503.58 feet from its intersection with the Northerly line of the Munson and Viall Allotment as recorded in Plat Book 3, Page 45 of Summit County Records of Plats; thence on said West line of road and 30 feet West from the East line of Portage Township North 40' East 78 feet and 3 inches; thence Southwesterly parallel to the center of the tract of the Cleveland-Mt. Vernon and Columbus Railroad and 33 feet Easterly therefrom about 202 feet to the land formerly owned by Mary Bidgood; thence North 87' along said Bidgood and now owned by said Railroad Co., 102 feet and 4 inches to the place of beginning and containing .09 acres, being land conveyed to the Hill & Adams Sewer Pipe Company by Michael Orth by deed dated August 5, 1869 and recorded in the records of Summit County, Ohio in Volume 65, Page 372.

TRACT 2:

Situated in the City of Akron, County of Summit and State of Ohio and known as being a part of Tract 7, formerly Portage Township, more fully described as follows:

Commencing at the Northeast corner of Lot 2, Munson & Viall Allotment as recorded in Plat Book 3, Page 25 of Summit County Records; thence N. 0 deg. 47' along the West line of N. Arlington Street (60 feet wide), a distance of 379.34 feet to an iron pin and the true place of beginning; thence S. 76 deg. 49' 59" W., along the North right of way line of the Erie Railroad, 500.00 feet to a pipe; thence N. 55 deg. 20' 57" E. by remaining land of Connecting Railway Company, a distance of 498.32 feet to an iron pipe in the Southerly line of land of Leon J. Rogers; thence N. 84 deg. 35' 46" by said mentioned land, a distance of 74.84 feet to an iron pipe on said West line of N. Arlington Street, and thence S. 0 deg. 47' E. along the said West line of N. Arlington Street, a distance of 176.50 feet to the place of beginning, containing 1.1985 acres of land, as surveyed by Richard Paul, Registered Surveyor #4351 in April 1967. Be the same more or less, but subject to all legal highways.

Property appraised at: Two Hundred Sixteen Thousand Dollars ($216,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 16th day of February, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
