By virtue of an Order of Sale No. CV2017 07 3002 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

And known as being all of Lot No. 7 in Turkeyfoot Heights Allotment, as recorded in Plat Book 47, Pages 28-34 inclusive, Summit County Record of Plats, and more fully described as follows:

And known as being a part of vacated Rutledge Drive (vacated April 10, 1959) in said city:

Beginning at the Northwesterly corner of Lot No. 7, in Turkeyfoot Heights as recorded in Plat Book 47, Pages 28-34, inclusive of the Summit County Record of Plats; thence N. 05 deg. 15' 48" E., along the Westerly line of said Turkeyfoot Heights, a distance of (25.00) feet to a point; thence S. 84 deg. 44' 12" E., a distance of (200.00) feet to a point; thence S. 05 deg. 15' 48" W. parallel to the Westerly line of said Turkeyfoot Heights, a distance of 45.00 feet to a point on the Easterly line of said Lot No. 7; thence Northwesterly, following the arc of a curve bearing to the left and having a central angle of 90 deg., a radius of 20.00 feet, a chord length of (28.28) feet, a tangent distance of 20.00 feet and an arc length of (31.42) feet, to a point of tangent set on the Northerly line of said Lot No. 7; thence N. 84 deg. 44' 12" W. along the Northerly line of said Lot No. 7, a distance of (180.00) feet to the place of beginning and containing an area of 0.1148 acres of land as determined in April, 1959, by Emmett J. McDonald, Registered Surveyor.

Property appraised at: One Hundred Thirty-eight Thousand Dollars ($138,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 16th day of February, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
