By virtue of an Order of Sale No. CV2017 05 2050 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 9TH DAY

OF FEBRUARY, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Tallmadge, County of Summit and State of Ohio:

Known as being a part of Original Lot No. 4, Tract No. 15, formerly Tallmadge Township, also known as the Southerly 165.00 feet East to West of Lot 32 and the Southerly 165.00 feet to the Easterly 10.00 feet of Lot 31 or the Richards Park Estates (unrecorded) and more fully described as follows:

Beginning at the intersection of the centerline of Newton Street (East Akron-Brimfield Road) and the centerline of South Munroe Road (Mogadore-Munroe Falls Road); thence N. 89 deg. 30' W., 183.58 feet along the centerline of Newton Street to a point; thence N. 00 deg. 30' E., 165.00 feet to a point; thence S. 89 deg. 30' E., 184.00 feet to a point on the centerline of South Munroe Road; thence S. 00 deg. 42' W., 165.00 feet along centerline of South Munroe Road to the place of beginning, containing 0.7020 acres of land as determined by C. J. Messmore, Registered Surveyor, April 1986, but subject to all legal street, highways and easements of record.

Property appraised at: One Hundred Seventeen Thousand Dollars ($117,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 23rd day of February, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
