By virtue of an Order of Sale No. CV2016 03 1184 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:


Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio:

And known as being a part of Lot No. 53 of the Warner's Corner Allotment as recorded in Plat Book 32, Pages 50 to 52 of the Summit County Record of Plats and more fully described as follows:

Beginning at a point on the East line of Lot No. 53 which is North a distance of 224.28 feet from the Southeast corner of said Lot No. 53; thence North 89 deg. 27' West, a distance of 180.01 feet to a point on the West line of Lot No. 53; thence North along the West line of Lot No. 53, a distance of 50.00 feet to a point; thence South 89 deg. 27' East, a distance of 180.01 feet to a point on the East line of Lot No. 53; thence South, along the East line of Lot No. 53, a distance of 50.00 feet to the place of beginning.

Subject to the following:

All matters as set forth on the plat of Warner's Corner Allotment recorded in Plat Book Volume 32, Pages 50-52 of the Summit County Records. Further subject to all covenants, conditions, restrictions, reservations and encumbrances of record and further subject to applicable zoning and all legal highways.

Property appraised at: Eighty-one Thousand Dollars ($81,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 2nd day of March, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
