Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot No. 2, Tract 13 of former Tallmadge Township, also known as being part of two parcels of land now owned by the City of Akron as described in Deed Volume 6980, Page 784 as recorded in the Summit County Records, more fully bounded and described as follows:

Beginning at a 5/8" I.P. set in the West right of way of Eastland Avenue, 60 feet wide, S. 45 deg. 56' 24" W., a distance of 148.73 feet as measured from the intersection of the West right of way line of Eastland Avenue with the South line of Arnold Avenue, 50 feet wide (both avenues as shown and recorded on a plat of Horizontal Control-Barber School C.D.A., Drwg. No. A-12904 of the City of Akron, Bureau of Engineering); thence from the true place of beginning, containing along said Eastland Avenue S. 45 deg. 56' 24" W., a distance of 60 feet to a 5/8" I.P. set therein, said point being in the South line of aforesaid Lot No. 2, Tract 13; thence along the South line of said Lot No. 2, N. 89 deg. 15' 29" W., a distance of 78.69 feet to a 5/8" I.P. set herein; thence parallel to the East line of Lot No. 123 of Preston Heights 1st Addition recorded in Plat Book 48, Page 45 of the Summit County Records N. 00 deg. 18' 31" E., a distance of 141.69 feet to a 5/8" I.P. set in the Southerly right of way line of aforesaid Arnold Avenue; thence along said Arnold Avenue N. 89 deg. 23' 7" E., a distance of 23.07 feet to a 5/8" I.P. set therein; thence S. 44 deg. 3' 36" E., a distance of 140.87 feet to the true place of beginning, containing 11,456 s.f. or 0.2630 acres of land more or less as surveyed by Gaskill & Associates, May 1986, but subject to all legal highways, rights, easements, convenants and restrictions of record, if any.

Property appraised at: Sixty-three Thousand Dollars ($63,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 23rd day of March, 2018. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
