By virtue of an Order of Sale No. CV2017 09 4002 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 16TH DAY

OF MARCH, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio:

And known as being all of Lot Number 167 in the Heslop Valley Heights Allotment, the plat of which is recorded in the Auditor's Office of Summit County, Ohio, in Plat Book 42, Pages 35-39 inclusive, except for the following, to-wit:

Beginning at the NW corner of said Lot Number 167, which point is also in the S. property line of Maitland Avenue; thence Southerly along the W. line of Lot Number 167, 65.0 feet to a point; thence Easterly at right angles to the previous line, a distance of 7.0 feet to a point; thence Northerly at right angles to the previous line and parallel to the W. line of Lot Number 167; thence Westerly along a line which is the arc of a curve in the N. line of Lot Number 167, a distance of 7.03 feet to the place of beginning. Subject to and together with all easements, restrictions and legal highways, if any, of record. Being the same property conveyed to Lisa M. Powell, by deed, dated April 21, 2009, recorded on April 24, 2009 in 55618579 of the Summit County, Ohio records.

Property located at: 2700 Maitland Avenue, Cuyahoga Falls, OH 44223.

Property appraised at: One Hundred Five Thousand Dollars ($105,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 30th day of March, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
