By virtue of an Order of Sale No. CV2017 11 4707 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 13TH DAY

OF APRIL, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio, and also known as Lots 341, 342, 343, in the Nesmith Lake Heights Allotment No. 2 as recorded is, Plat Book 26, Page 54 of Summit County Records of Plats.

Excepting therefrom the following:

Situated in the City of Akron, County of Summit and State of Ohio, and known as being all Lot No. 341 and part of Lot No. 343 in Nesmith Heights Allotment No. 2, recorded in Plat Book 26, Page 54 of the Summit County Records, further bounded and described as follows:

Beginning at a #4 rebar and I.D. Cap #6541 set this survey at the Northeast corner of Lot No. 341.

Course 1:

Thence South 22 deg. 10 min. 13 sec. West along the East line of Lots No. 341 and 343 and the West line of Christensen Avenue, 45 feet wide, distance of 148.15 feet to a drill hole set in a sandstone this survey at the Southeast corner of Lot No. 343.

Course 2:

Thence North 67 deg. 57 min. 47 sec. West along the South line of Lot 343, a distance of 60.00 feet to a #4 rebar and I.D. Cap #6541 set this survey.

Course 3:

Thence North 22 deg. 10 min. 13 sec. East through Lot No. 343 and along the West line of Lot No. 341, a distance of 147.97 feet to a #4 rebar with I.D. Cap #6541 set this survey on the South line of West Waterloo Road, 60 feet wide.

Course 4:

Thence South 68 deg. 08 min. and 00 sec. East along the South line of West Waterloo Road, a distance of 60.00 feet to the place of beginning and containing 0.2039 acres or 8,883.5 square feet of land, be the same more or less, but subject to all legal rights and easements of record and surveyed in November 1993, by John W. Patrick, Jr., Professional Surveyor #6541. The plat bearing of South 65 deg. 08 min. 00 sec. East along the South line of West Waterloo Road, as described in Plat Book 26, Page 54, Summit County Records, was used as the "Basis of Bearings" for this legal description.

Prior Deed Reference: Volume 1721, Page 1117.

Property located at: 420 W. Waterloo Road, Akron, OH 44314.

Property appraised at: Sixty Thousand Dollars ($60,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 27th day of April, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
